I purchased this, and if he just replaced the licensed artwork, it'd be in compliance with the Foundry rules. I get that the images themselves may be public, but a) the IP's (i.e. characters in the artworks) are not, and b) the use of those IP's are a breech of the Foundry Rules. But by all means, I'd still recommend putting the product here, just a change of licensed IP art is all. Hello Chris. Reading your explanation and going back and reading the prior feedback I now see the point that the image as an IP is distinct from what the image represents as an IP.

Your link is missing some parts but I see that it's a search here on DriveThruRPG. I'll take my PDF down shortly, search for the art, replace it in my PDF, and upload it again.

Hello Guillaume. I'm not an IP lawyer, but by my reading of the licensing agreement I believe the term IP means that someone actually owns the IP, otherwise it's not really IP. No one owns the images I used so they cannot be classified as IP.

I could be completely wrong. If I get a cease and desist letter, I'll change the art or take it down accordingly. Thank you for sharing your feedback, I greatly appreciate it.

Being part of the original Foundry team, I assure you that what you do is illegal. Art or not, Foundry doesn't allow you to make a setting of an existing IP other than Android and Terrinoth.
Basically, the art is just an additional problem. Even if it was artless, your doc is still illegal due to being an existing IP setting not authorized by Foundry.

Hello Guillaume. My understanding is that it’s not an existing IP because someone has to own it for it to be such. Something is either an intellectual property or a public domain property - it cannot be both at the same time in the same jurisdiction.

With that said, I’m not an IP lawyer so I know I may be completely wrong on this point. If I am, I’m sure I’ll get a cease and desist letter and I’ll gladly take action at that time.

Thank you for sharing your thoughts and experiences on this, I’m very grateful for your concern for all parties involved.

Hello. All art is in the public domain. I got it from Comicbookplus.com where it has been publicly displayed since 2006. If I'm mistaken , I'll take appropriate action. Thank you for letting me know.

Even with public art, and even if you did own the rights for the arts, Foundry license forbids making docs about existing IP beside Terrinoth and Android. So you cannot do Marvel Universe setting.

Just because something is on a website does not make it public domain. DC Comics still owns the rights to those characters and you cannot use them in products that you sell. Additionally, the Genesys Foundry agreement says you cannot use third-party IP even if you have the rights.

These products were created by scanning an original printed edition. Most older books are in scanned image format because original digital layout files never existed or were no longer available from the publisher.

For PDF download editions, each page has been run through Optical Character Recognition (OCR) software to attempt to decipher the printed text. The result of this OCR process is placed invisibly behind the picture of each scanned page, to allow for text searching. However, any text in a given book set on a graphical background or in handwritten fonts would most likely not be picked up by the OCR software, and is therefore not searchable. Also, a few larger books may be resampled to fit into the system, and may not have this searchable text background.

For printed books, we have performed high-resolution scans of an original hardcopy of the book. We essentially digitally re-master the book. Unfortunately, the resulting quality of these books is not as high. It's the problem of making a copy of a copy. The text is fine for reading, but illustration work starts to run dark, pixellating and/or losing shades of grey. Moiré patterns may develop in photos. We mark clearly which print titles come from scanned image books so that you can make an informed purchase decision about the quality of what you will receive.
Original electronic format
These ebooks were created from the original electronic layout files, and therefore are fully text searchable. Also, their file size tends to be smaller than scanned image books. Most newer books are in the original electronic format. Both download and print editions of such books should be high quality.
